Man Brutally Beats 4-Month-Old Boy To Death After He Learns He's Not The Father

Jose Avila-Agurcia, 33, was enraged after finding out that the boy, Alexander Lizondro-Chacon was not his biological son. US immigration office later also found that Avila-Agurcia was staying illegally in the country and had previously been removed five times.

A 4-month-old-boy died after being repeatedly hit by a man who thought he was the father of the baby. He was angry when he found out that the baby was not his biological son and proceeded to hit him several times on the head reports the New York Post. The abuse took place in Tennessee and the man fatally wounded the baby. 33-year-old Jose Avila-Agurcia of Memphis is facing a charge of first-degree murder for the death of Alexander Lizondro-Chacon. He has been charged with aggravated child abuse that led to the death of the boy on April 12. Avila-Agurcia was living with his partner Mercy Lizondro-Chacon and the baby at Court Avenue. Lizandro-Chacon made an emergency call after she complained that her son had problems with breathing. According to the Commercial Appeal, the affidavit of the complaint stated that officers were called for a report of a baby who was unresponsive. The infant was taken by ambulance to Le Bonheur Children's Hospital.  As per The New York Post, the baby was declared dead at the hospital.  The baby suffered from blunt force trauma as a result of being repeatedly hit.  In addition to the severe injury, the boy also had pneumonia that may have further complicated his health.





However, it appeared that the immediate reason for his death was the blunt force injury rather than pneumonia. In addition to the head injury and fractured skull, Alexander also had a fractured rib. Two days later the boy's mother and Avila-Agurcia gave statements to investigators indicating that they cared for the infant. However, when asked about how the baby sustained injuries, they said that they had no idea according to the affidavit. The police, however, suspected there was something more at play. 


While Avila-Agurcia was a suspect in the case, it later emerged that he did indeed kill the boy in an act of rage. Lizondro-Chacon later told detectives that her partner had admitted to hitting the baby several times on the head because he was livid that he was not the father, the affidavit states. Authorities, however, do not know who the real father of the boy is. According to a WREG, the Shelby County medical examiner has ruled the boy’s death as a case of homicide. 





Avila-Agurcia is a Honduran citizen who has been staying in the US illegally and is set to be deported. His real name is Carlos Zuniga-Aviles, and he was using an alias according to the US Immigration and Customs Enforcement. His real identity was also later confirmed through biometrics.  What's surprising is that Avila-Agurcia had been caught on several other occasions by officials, and removed from the country five times earlier.


Avila-Agurcia is presently in jail without bond and is waiting to make his initial court appearance on April 25.   Several people were outraged at Avila-Agurcia's actions and took to social media to comment on his heinous crime. On Facebook, Florence Ann Cecce wrote: I hope that he meets a guy in prison, that's twice his weight and gives the same to him.....on a daily basis. Judy Hucle Atilano commented: As sad and sickening as this story is, i’m just glad GOD came and got this baby now. Because can you imagine the torture, abuse humiliation this beautiful child would have went through living with this monster. RIP ANGEL 😇 GODS GOT YOU NOW🙏🏼
